Civil or Commercial Litigation

Civil litigation is a method of resolving disputes or claims between individuals, companies, local authorities and/or government departments.

 

Most of such claims or disputes arise from a breach of contract or negligence. The first arises where one party has broken a contract or agreement between two or more parties. The agreement need not be in writing, although if it is, it is often easier to establish that one party has broken the terms of the agreement.

 

Claims or disputes based upon contract can vary from a minor case involving the purchase of defective goods to a high value claim arising out of a building contract.

 

Claims for damages for negligence arise where one party has suffered loss and damage as a result of a lack of care or a beach of duty by some other party. Such claims include claims for personal injury or claims for financial loss arising from the negligence of a third party such as a surveyor or accountant.

 

Other civil disputes include disputes over the ownership or use of property, damage to reputation and debt recovery.

 

The resolution of such disputes may involve proceedings in the civil courts or alternative dispute resolution (ADR) such as arbitration or mediation.
